Welcome to BirdMate. By accessing or using our website, mobile app, or AI birding companion services (collectively, the “Service”), you agree to be bound by these Terms of Use and Service.

1. Eligibility

You must be at least 13 years old to use BirdMate. If you are under 18, you confirm that a parent or legal guardian has reviewed and accepted these terms on your behalf.

2. Your Account

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized use.

3. AI Identifications

BirdMate’s AI provides bird identifications and educational content for informational and recreational use. Identifications are probabilistic and should not be relied upon for scientific research, conservation decisions, or any safety-critical purpose without independent verification.

4. Your Content

You retain ownership of photos, recordings, notes, and other content you submit. By submitting, you grant BirdMate a worldwide, royalty-free license to host, process, and display your content for the purpose of operating and improving the Service.

5. Subscriptions and Payments

Some BirdMate features require a paid subscription. Subscriptions renew automatically until canceled. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods unless required by applicable law.

6. Acceptable Use

You agree not to misuse the Service. Prohibited activity includes scraping at scale, reverse engineering, submitting unlawful or harmful content, harassing other users, and circumventing access controls.

7. Termination

We may suspend or terminate access at our discretion, with or without notice, for violations of these terms or to protect the Service and its users.

8. Disclaimer

BirdMate is provided “as is” without warranties of any kind. To the fullest extent permitted by law, BirdMate is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

9. Changes

We may update these terms occasionally. Material changes will be announced through the Service or by email. Continued use after a change means acceptance of the updated terms.
